StreamSpook Terms of Service
These Terms of Service (hereinafter referred to as the "Terms") set forth the conditions for using the software "StreamSpook" (hereinafter referred to as the "Software") provided by Masashi Akisue (trading as Fortyworks; hereinafter referred to as the "Operator") on Steam, operated by Valve Corporation (hereinafter referred to as "Valve").
Article 1 (Application)
- These Terms shall apply to the relationship between the Operator and the User regarding the use of the Software.
- The User shall review these Terms and the Privacy Policy, and use the Software upon agreeing to these Terms. If the User commences use of the Software, they shall be deemed to have agreed to these Terms.
- These Terms supplement the Steam Subscriber Agreement as "Subscription Terms" relating to the Software. The User shall also comply with the terms and conditions of any external services, and such terms and conditions shall take precedence in respect of matters governed by those services.
Article 2 (Eligibility)
- Minors shall use the Software only after obtaining the prior consent of their legal representative.
- The User shall comply with the terms of service of Steam and Twitch, as well as Twitch's Community Guidelines, and shall obtain and manage any necessary accounts at their own responsibility.
- To use the Twitch integration features, the User must meet the age requirements set by Twitch.
Article 3 (Acquisition and Payment via Steam)
- The Software is provided on Steam as a one-off purchase.
- The Operator may offer paid options in the future. The details and prices of such options will be displayed on the purchase screen.
- The agreement for the purchase of the Software is between the User and Valve, and purchases and refunds are subject to the information displayed on the Steam Store and the Steam Subscriber Agreement.
- The User shall, at their own expense, prepare the equipment, an internet connection, accounts, and external software necessary for using the Software.
Article 4 (Licence)
- The User may use the Software on a non-exclusive basis in accordance with these Terms and Steam's conditions of use, for as long as their right to use the Software through Steam remains valid. The right of use may not be transferred or sub-licensed.
- The User may use the Software for their own streams involving advertising revenue, subscriptions, tips or donations, or similar forms of monetisation. However, the User may not sell, rent, redistribute, or grant any third party a licence to use the Software.
- Use on multiple devices and other aspects of the scope of use associated with the Steam account shall be subject to the conditions set by Steam.
Article 5 (Functions of the Software)
- The Software integrates with Twitch to provide functions such as chat display, text-to-speech, translation, subtitles, visual effects, stream settings, stream history, analytics and other functions. Specific functions are as displayed within the Software, on the official website, or on the Steam Store.
- Assessments and analytical results provided by the Software concerning volume levels, network conditions, PC load and other factors are for reference purposes only, and the Operator does not guarantee their completeness or accuracy.
- The Operator may, within a reasonable scope, add, modify, or discontinue functions for the purpose of improving the quality of the Software, carrying out maintenance, or complying with laws and regulations.
Article 6 (Operating Environment and External Software)
- The supported operating systems for the Software are Windows 10 and Windows 11.
- The Software is provided through Steam and integrates with Twitch and OBS Studio. Certain features may require a Twitch account or external software, such as VOICEVOX.
- Steam, Twitch, OBS Studio, Microsoft Edge, Google Chrome, VOICEVOX and other services or software provided by third parties (collectively, the "External Services") are provided under the responsibility of their respective providers. The Operator does not guarantee the operation, availability, security or any other aspect of the External Services. Furthermore, due to changes in specifications, suspension, termination, or changes in the terms of use of External Services, the Software, in whole or in part, may become unavailable.
Article 7 (Data Stored on the User's Device and Backups)
- Chat logs, blocklists, stream history, analytical results, and notes are saved locally on the User's device. The Operator does not collect or store such data.
- Even when using Steam Cloud, only visual effects and other app settings are stored in Steam Cloud. The data mentioned in the preceding paragraph is not saved on Steam Cloud.
- The Software allows users to use Microsoft Edge's online speech recognition feature. When using this feature, voice data is transmitted to Microsoft's servers, but the Operator does not collect or store such voice data.
- Google Chrome's speech recognition and the translation functions of both Google Chrome and Microsoft Edge operate locally on the User's device.
- Speech synthesis by VOICEVOX is performed locally on the User's device.
- The User shall be responsible for managing the data stored on their device and shall make backups as necessary. In the event that data is lost due to device failure, user error, deletion or updating of the Software, or any other cause, the Operator shall not bear any responsibility, except where the loss is caused by an intentional act or gross negligence on the part of the Operator.
Article 8 (Handling of Viewer Information, etc.)
- The User shall handle viewers' usernames, chats, follows, subscriptions, support using Bits, and other information collected or saved through the Software in accordance with applicable laws and regulations and Twitch's terms of use.
- The Operator shall not be responsible for taking any action required by law on behalf of the User in relation to third-party information handled by the User using the Software.
Article 9 (User Content)
- Rights pertaining to images, audio, video, text, fonts and other materials that the User uploads to or imports into the Software (hereinafter referred to as "User Content") shall belong to the User or the respective rights holder.
- The User warrants that they have all rights and permissions necessary to use the User Content within the Software.
- Should any dispute arise with a third party regarding User Content, the User shall resolve it at their own responsibility and expense.
Article 10 (Prohibited Acts)
- When using the Software, the User must not engage in acts that violate applicable laws or public policy; acts that infringe upon the rights of third parties; or acts that involve unauthorised access or compromise security.
- Except as permitted by law, the User must not copy, modify, adapt, reverse-engineer, decompile, disassemble, or analyse the source code of the Software.
- The User must not sell, resell, rent, redistribute, or share the Software or its licence with third parties, circumvent technical restrictions relating to the Software or its licence, or engage in any other conduct that interferes with the operations of the Operator or External Services.
- The User must not use the Software for the purpose of discrimination, making threats, harassment, illegal solicitation, or otherwise causing disadvantage to third parties.
Article 11 (Intellectual Property Rights)
- Copyright, trade mark rights and other intellectual property rights relating to the Software, the official website, manuals and other content provided by the Operator shall belong to the Operator or the respective rights holders.
- The licence granted under these Terms does not transfer any of the intellectual property rights referred to in the preceding paragraph to the User.
Article 12 (Updates)
- The Software may be updated automatically through Steam. The User acknowledges and agrees that updating to the latest version may be required in order to continue using the Software.
- Updates may result in changes to the operating environment, functions, screens, or the format of data stored on the User's device.
Article 13 (Response to Violations)
- If the User violates these Terms, the Operator may require the User to cease or remedy the violation.
- If the violation mentioned in the preceding paragraph is material, or if the violation is not remedied despite the User having been given a reasonable period to remedy it, the Operator may terminate the licence to use the Software under these Terms and require the User to cease using the Software.
- Any suspension, invalidation or refund relating to the User's right to use the Software on Steam shall be in accordance with Valve's conditions and applicable laws.
- Even after the termination of the licence under these Terms, Article 9, Paragraph 3, and Articles 10, 11, 14, 15 and 18 shall remain in full force and effect to the extent necessary in view of their nature.
Article 14 (Disclaimer of Warranties)
- The Operator provides the Software on an "AS IS" and "AS AVAILABLE" basis and does not warrant its fitness for a particular purpose, merchantability, accuracy, completeness, continuity, uninterrupted availability, or absence of errors or defects.
- The Operator does not warrant any results, including stream quality, viewer numbers, revenue, ratings or other outcomes, resulting from the use of the Software.
- The Operator does not warrant that the use of the Software will not result in the suspension of an account, deletion of posts, or any other action being taken on an External Service.
Article 15 (Limitation of Liability)
- In the event that the Operator bears liability for damages to the User regarding the Software, such liability shall be limited to direct and ordinarily incurred damages, and shall in no event exceed the amount actually paid by the User to acquire the right to use the Software on Steam, except in cases of intent or gross negligence on the part of the Operator.
- The Operator shall not be liable for lost profits, loss of data, business interruption, or any other special or indirect loss or damage, except in cases of intent or gross negligence on the part of the Operator.
- The limitations of liability in this Article and elsewhere in these Terms shall not apply to the extent that such limitations are not permitted under the Consumer Contract Act or other mandatory provisions of law.
Article 16 (Amendments to the Terms)
- The Operator may amend these Terms in accordance with Article 548-4 of the Civil Code of Japan or other applicable laws when there are changes in laws and regulations, changes in the functions of the Software, or when otherwise necessary.
- When amending these Terms, the Operator shall notify Users of the details of the amendments and their effective date by posting them on the official website, through notifications within the Software, or by other appropriate means. For amendments that materially affect the User's rights or obligations, the Operator shall obtain the User's consent where necessary.
Article 17 (Communication and Notices)
- For enquiries or other communications concerning these Terms, bugs in the Software, or other matters relating to the Operator, please contact forty@fortyworks.jp or the Software's forum on Steam. However, the Operator does not provide individual support for enquiries regarding how to use the Software.
- For enquiries regarding purchases, refunds, or accounts on Steam, please contact Steam Support.
- Notices from the Operator to the User shall be given by posting on the official website, displaying notices within the Software, posting notices on Steam, or any other method deemed appropriate by the Operator.
Article 18 (Governing Law and Jurisdiction)
- These Terms shall be governed by and construed in accordance with the laws of Japan. However, this shall not preclude the application of mandatory laws of the User's place of residence.
- If there are translated versions of these Terms, the Japanese-language version of these Terms on which the translation is based shall be the authoritative version. In the event of any discrepancy in content or interpretation, the Japanese-language version shall prevail.
- In the event that a dispute arises between the Operator and the User based on these Terms, the Chiba District Court or Chiba Summary Court shall have exclusive jurisdiction as the court of first instance, unless otherwise provided by law.
Article 19 (Severability)
If any provision of these Terms is held to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
